1. Company Presentation

Ekipazo specializes in the creation and sale of personalized sports products, including clothing, accessories, and bags. These terms and conditions of sale (T&Cs) govern all sales made on the website https://www.ekipazofutbol.com. By placing an order, you accept these T&Cs without reservation.

2. Product Characteristics

Products sold by Ekipazo are 100% customized and made to order based on specifications provided by the customer (size, color, markings, etc.). The descriptions and photos on the site, as well as the mockups sent by email and/or WhatsApp, are as accurate as possible, but slight differences may exist between the final product and its online representation. This may be due to technical constraints or differences in color display between screens and printing materials.

3. Price Display

For customers in the European Union, the prices displayed on our website include all taxes (VAT included). For customers outside the EU, prices are shown excluding taxes (excl. VAT), and additional fees (such as local taxes or customs duties) may be required upon delivery. Prices may change at any time, but products will be billed based on the current rate at the time of order confirmation.

4. Orders and Customization

Orders are placed exclusively online through our website. The order process includes validation of customization (model, size, markings). A mockup will be sent to you before production to confirm the details of your product. Once the order is confirmed and the mockup is approved, it is final and cannot be modified.

5. Payment

We offer several secure payment methods:

• Credit cards: Visa, Mastercard, American Express via Stripe and Systempay.
• Bank transfer: Information for making the transfer will be provided upon order confirmation.

6. Delivery

6.1 Delivery Times

Delivery times range from 2 to 3 weeks after order confirmation for personalized accessories (armbands, pennants, scarves, and flags); 3 to 4 weeks for clothing and bags. For deliveries outside the EU, additional time may apply, as well as for orders with a high number of items (100 or more for accessories, 50 or more for clothing and bags). This additional time will be communicated to the customer.

Delivery times are calculated from the date of payment receipt AND mockup confirmation, which must be done by responding to the email or WhatsApp message sent by our services. It is the customer's responsibility to pay attention to the confirmation request to avoid production delays.

Delivery fees are calculated based on the destination and weight of the ordered items. Delivery is provided through partner carriers, and responsibility is transferred upon receipt of the products by the customer.

6.2 Delivery Delay

We strive to meet the delivery times indicated when the order is confirmed. However, in case of delay, several scenarios may occur:

• Delay attributable to the customer: If the delay is due to a failure on the customer's part (e.g., late payment, late mockup confirmation, or late submission of sizes), Ekipazo cannot be held responsible. Delivery times will be recalculated from the date of payment receipt and/or mockup confirmation.
• Delay attributable to the carrier: Ekipazo works with partner carriers and cannot be held responsible for delivery delays caused by the carrier (strikes, technical incidents, unforeseen delays, etc.). In this case, we will do our best to resolve the situation with the carrier.
• Delay attributable to Ekipazo: In the event of a delay directly attributable to Ekipazo, the customer will be informed as soon as possible. If the delay exceeds 10 days beyond the initially announced time, the customer may request compensation, which will be evaluated on a case-by-case basis.

No penalties can be claimed if the delay is due to force majeure (strikes, natural disasters, pandemics, etc.) or circumstances beyond Ekipazo's control.

7. Return Policy

Due to the unique and personalized nature of the products, returns or exchanges are not accepted, except in the following cases:

• Manufacturing error: Product does not match the order (model, size, markings). Regarding sizes, it is the customer's responsibility to carefully consult the size guide available on our website, which contains all product dimensions. The provided measurements have a margin of error of 1 cm. We strongly advise customers to measure similar products they own to compare with our brand's sizes, as sizes may vary from brand to brand, even if the size indication is the same. It cannot be considered a size error if the delivered product corresponds to the dimensions indicated in the size guide (with a margin of ±1 cm).
• Defective product: Obvious defect or damage caused during delivery.
• Clear color error: If the color obtained significantly differs from the one requested. For colors derived from codes provided by the customer, minor variations may occur due to manufacturing processes or display differences. For reorders or reprints, slight tone differences may appear. These discrepancies are not considered manufacturing errors.

8. Personal Data Protection

We are committed to the confidentiality and protection of your personal data. The information you provide us when placing your order (name, address, email) is used solely to process and deliver your order. We do not share your data with third parties for commercial purposes.

9. Right of Withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to personalized products. Once the order is confirmed and production has started, no cancellation or refund is possible, except in the cases mentioned in the Return Policy.

10. Warranty and Liability

All our products are covered by the legal warranty of conformity and the warranty against hidden defects. In case of non-conformity or defect, you must inform us as soon as possible so that we can proceed with an exchange or refabrication.

11. Intellectual Property

Custom creations made on our website remain our property until full payment is received.

By submitting logos, trademarks, images, texts, or any other element for the customization of our products, you guarantee that you hold all the necessary rights to use them. This includes copyright, intellectual property rights, and rights to registered trademarks. You agree not to provide content that would infringe on the rights of third parties, especially industrial or artistic property rights. In the event of a dispute or claim related to a violation of these rights, you will assume full legal responsibility and will hold Ekipazo harmless from any legal, financial, or other consequences.

Please note that Ekipazo does not manufacture products bearing the logos, colors, or trademarks of professional football clubs, due to the intellectual property rights held by these clubs. Any order including such elements will be refused (unless the request comes directly from the concerned professional club). Although we do our best to verify and identify protected elements, it is possible that a logo, trademark, or visual identity of a professional club may not be recognized as such. In this case, if the order is nevertheless validated and executed, full responsibility lies with the customer. The customer guarantees that they have the necessary rights and holds Ekipazo harmless from any liability related to the use of such elements.
